Cleveland Circle building owner sues to block neighboring pot shop … – Universal Hub

The Hamilton Co., which owns the office building at 392-398 Chestnut Hill Ave. in Cleveland Circle, today sued to try to block plans by an Ipswich concern to turn the former Dunkin’ Donuts on Beacon Street into a marijuana dispensary.

In its lawsuit, filed in Suffolk Superior Court against both dispensary operator Happy Valley and the Boston Zoning Board of Appeal, which approved the proposal on Sept. 12, Hamilton Kevinized its arguments against the proposal, charging it would become an ID-ignoring pot haven for the thousands of high-school and college students who already swarm the area in a Cleveland Circle that would quickly become gridlocked by hordes of pot buyers “from outside the neighborhood” all apparently driving in instead of using any of the nearby Green Line stops and all creating further havoc by getting into car crashes.

The proposed location is across Beacon Street from a full-service liquor store.

The lawsuit also asks the court to “annul” the zoning approval because the proposed location would violate Boston’s frequently ignored half-mile buffer between marijuana establishments, since Happy Valley earlier won approval to turn the one-time Mary Ann’s next to the Dunkin’ Donuts into a dispensary. Judge temporarily blocks cumulative fee hike for Montana marijuana dispensaries – Daily Montanan – Daily Montanan

A district court judge last week granted a 60-day preliminary injunction blocking the State of Montana from assessing and collecting increased fees from businesses that operate multiple marijuana dispensaries across the state – changes passed by the legislature this year in the final days of the session.

The state and attorneys for three Montana marijuana businesses last Tuesday agreed to ask Lewis and Clark County District Court Judge Mike Menahan to issue the 60-day preliminary injunction because the renewal fees are coming due, and the businesses say they would be forced to close several locations, lay off workers and keep medical marijuana patients from getting their products in the event the have to pay the fees. He granted the request on Wednesday.

Attorneys for the plaintiffs – Granite Peak Holdings, Inc. doing business as Elevated; TSB Montana LLC, and MariMint LLC – challenged the new fee structure passed through an amended version of House Bill 903 in the final two weeks of the 2023 legislative session, in a lawsuit initially filed in August.

Menominee pot shops back in business after temporary restraining order lifted – Fox11online.com

MENOMINEE, Mich. (WLUK) — A temporary restraining order that shut down three of Menominee’s five marijuana dispensaries has been lifted after 10 days.

An emergency court hearing was held Monday to discuss the legality of the court order which forced pot shops Higher Love, Lume Cannabis Company and Nirvana Center to close, putting nearly 70 people out of work.

Circuit Court Judge Mary Barglind’s decision comes in response to a motion filed by the city of Menominee which asked for clarification on the Nov. 3 court order.

In 2021, the city of Menominee awarded marijuana retail permits to two dispensaries: Rize and The Fire Station.

The dispensaries that were not awarded permits sued and were eventually given permits under a new ordinance passed after turnover on Menominee’s city council, which led to lawsuits by Rize and The Fire Station.

A final decision is expected later this week. Both Higher Love and Lume Cannabis Company have reopened for business, but there is no word yet on Nirvana Center.

NuEra Cannabis breaks ground on marijuana dispensary in DeKalb – Shaw Local

DeKALB – NuEra Cannabis, the second of two marijuana dispensaries slated for DeKalb, is entering a new era in its hopes of setting up shop in town in early 2024.

On Monday, project leaders joined city staff for a groundbreaking ceremony to celebrate the start of work that will commence on the building at 818 W. Lincoln Highway. DeKalb City Manager Bill Nicklas and city planner Dan Olson were present.

The 4,834 square-feet space, now vacant, used to be home to the former Book World in The Junction Shopping Center.

Plans for the soon-to-be marijuana dispensary have been a long time in the making, officials said.

“We are absolutely delighted,” NuEra Cannabis chief operating officer Laura Jaramillo Bernal said. “We really thought that we would’ve been up and running years ago, but the cannabis licensing process has been much slower than everybody expected. Also, the COVID-19 pandemic slowed everything a lot more than everyone expected. So, it’s taken everything a little while, but both the city and our landlord have been incredibly supportive and incredibly patient. We are so excited to finally be breaking ground today and hopefully opening up our doors to the public in quarter one next year.”

Settlement in NY cannabis case could restart long delayed legal weed dispensary rollout – New York Daily News

A lawsuit against NY cannabis regulators that had stalled the opening of new legal weed dispensaries has been resolved, opening the door to the resumption of the long-delayed rollout.

A group of service-disabled veterans who sued the state over licensing for legal pot shops has “reached an agreement in principle” to settle the lawsuit,  a lawyer for the plaintiffs wrote to a state appeals court Monday.

The lawsuit was filed by four service-disabled veterans who charged that the state program to prioritize social justice goals by first giving out licenses to people impacted by the War on Drugs and their families was illegal.

The settlement has yet to be finalized, but the news of a tentative agreement sparked chatter in group chats among prospective dispensary owners. The letter offer hope for cannabis entrepreneurs who’ve suffered financial loss and mental stress during the three-month-long injunction.

The lawsuit, filed in August, alleges the state’s Cannabis Control Board overstepped its authority and violated its own cannabis law by opening the retail license application first to those with marijuana-related offenses and their families — instead of opening applications to the general public.

Maui Wellness Group, LLC gets approval as medical cannabis retail dispensary – Maui Now

The Hawai‘i State Department of Health has issued a formal notice to proceed for Maui Wellness Group, LLC, dba Maui Grown Therapies after it passed its final on-site inspection for its fourth retail facility. Maui Grown Therapies’ new retail site is located at 1215 South Kīhei Road D-2 in Kīhei, and the company expects to begin sales on Friday, Nov. 17, 2023.

Maui Grown Therapies’ Kīhei location will be Maui’s eighth retail dispensary (counting the location destroyed in Lahaina by the Aug. 8 wildfires) and the 25 retail dispensary for the state.

As of Oct. 31, 2023, a total of 30,852 in-state patients and 2,682 caregivers were registered statewide, including 5,302 patients and 465 caregivers on Maui.

The primary reported condition for registered adult patients is severe pain. The primary reported conditions for patients under 18 are seizures and post-traumatic stress disorder. “Maui Grown Therapies’ new dispensary will provide much-needed access to patients on Maui, especially as its Lahaina dispensary was destroyed in the Lahaina wildfires,” said DOH Dispensary Licensing Supervisor Liam Gimon.
