New York Cannabis: Microbusiness Licenses
As we previously broadly summarized on December 27, 2022 (here), in late December 2022, the Office of Cannabis Management (“OCM”) released its first proposed adult-use cannabis rules and regulation for New York (the “Proposed Regulations”). The official document is 282 pages, so we won’t cover every detail. But we will highlight the big-ticket items, significant issues that all applicants should be aware of, and the license application process as a whole. Also, keep in mind that the Proposed Regulations are still pending as OCM receives the final public comments to the Proposed Regulations.
One of the less defined and still ambiguous portions of the Proposed Regulations relates to those applying for a cannabis license as a microbusiness, as we await on the determination of the size and scope of eligible microbusinesses.
What are microbusinesses and their licenses?
A microbusiness is a cannabis business subject to certain size and operational restrictions. The Marijuana Regulation and Taxation Act (the “MRTA”) allows certain businesses with less access to capital to enter into the legal cannabis market by applying for a microbusiness license which authorizes the small-scale production, sale, and delivery of cannabis.

NC Senate votes on medical marijiuana: 5 things to know – Spectrum News
A bill legalizing medical marijuana in North Carolina passed a floor vote in the state Senate Tuesday, where it has strong bipartisan support.
The bill, which passed 36-10, will have to have one more vote in the Senate, but that is mostly a pro-forma vote. The bill then heads to the House, where its fate is less certain.
The N.C. Compassionate Care Act, SB3, passed the Senate last year but stalled out in the House. This year’s bill is essentially the same as last year’s with some minor changes. It would legalize medical marijuana in North Carolina through tightly regulated prescriptions and dispensaries.
“It seems to me that the idea is gaining momentum and obviously there’s strong support in the Senate,” said Rep. Jon Hardister, a Guilford County Republican and the majority whip in the House. “In general, it seems like the attitude among members of the House is shifting more in favor of the legislation.”
Who could get a medical marijuana prescription?
The bill would only allow medical marijuana to be prescribed to people with “debilitating medical conditions.” In the current proposal, those conditions are:

Rogers Park Dispensary Asks To Move Into Store Next To Howard … – Block Club Chicago
ROGERS PARK — The Zen Leaf dispensary in Rogers Park is looking to move from its original location to a larger spot within in the Gateway Center Plaza on the Evanston border and next to the Howard Street CTA terminal.
The proposed relocation comes after an earlier attempt to move into the closed Leona’s restaurant at 6935 N. Sheridan Road was protested by neighbors and eventually nixed by Ald. Maria Hadden (49th).
The leaders of Zen Leaf, which is now at 7305 N. Rogers Ave., need city approval to move into a storefront at 7541 N. Clark St., according to Hadden.
Moving out of the Rogers Avenue spot would allow Zen Leaf to expand, taking it out of a more residential setting and into a prominent space in a commercial development.

Zen Leaf’s parent company, Verano, bought what was then known as Green Gate Dispensary in 2021. Green Gate opened as a medical-only dispensary on Rogers Avenue before recreational pot was legalized.

BENNINGTON — Silver Therapeutics has obtained licensing approval from the Vermont Cannabis Control Board for a dispensary on Northside Drive and expects to have the newly renovated store operating by mid-March.
“I’m thrilled,” said Brian Mullaney, of Shaftsbury, who will manage the Bennington dispensary and is also regional manager for Silver Therapeutics.
He said the state board approved the company’s license application on Monday. Mullaney said opening a Bennington store — near his home town — has been a priority of his.
The building at 201 Northside Drive, with about 1,567 square feet of interior space, has been undergoing renovations since the fall.
The property, which will be leased from owner Monument Holdings, LLC, is the site of a former firearms shop and is located near the entrance to the Walmart-Price Chopper shopping center.
REGIONAL COMPANY
Silver Therapeutics currently operates a recreational cannabis dispensary in Williamstown, Mass. That dispensary opened in 2019 in the Colonial Shopping Center on Main Street, or Route 2.
The company also operates dispensaries in Maine, including two in the Portland area, and one in Palmer, Mass. Another is expected to open soon in Boston.
Silver Therapeutics also has a cultivation facility in Brunswick, Maine.
Morristown gives green light to town’s first cannabis dispensary – Daily Record
Morristown’s first cannabis dispensary is officially in the works after the Planning Board gave approval for a two-story building on Ridgedale Avenue that will house the business.
The board voted 7-0 on Thursday to approve the 4,650-square-foot dispensary, aftermore than three hours of testimony. The store is planned for the former Sam’s Automotive Repair site near the Morris Township border. The property is currently owned by the neighboring Morris Brick and Stone Co., which will lease it to Massachusetts-based Uma Flowers to run the weed business.
No opening date was discussed for the store, which will offer both recreational and medicinal marijuana products.
Uma Flowers is co-owned by sisters-in-law Tejal and Priyanka Patel, who told the board they worked in the fields of public health and pharmacy, respectively, before starting the cannabis company a year ago.
Morristown Mayor Tim Dougherty, who also sits on the Planning Board, praised the “stellar” work by the board in selecting the town’s first dispensary. The panel took its time to understand the operations, he said, and as a result left Thursday’s meeting impressed with the Patels’ thorough presentation.
