HOT SPRINGS — The only medical marijuana dispensary in Hot Springs will remain closed after a judge denied the owner’s request to stay the state’s May 2 order revoking the dispensary’s license.
Garland County Division 4 Circuit Judge Kara Petro ruled Thursday that Dragan Vicentic didn’t prove his appeal was likely to succeed, keeping the doors to Green Springs Medical closed while his petition for judicial review waits to be heard.
The denial came after a hearing Wednesday at the Garland County Courthouse.
Selling expired products, lax inventory controls, mislabeled products and discrepancies in physical and electronic inventories were among the violations Petro cited. The noncompliance was initially detailed in a May 2 order by Christy Bjornson, director of the state Department of Finance and Administration’s Alcoholic Beverage Control Division.
The Alcoholic Beverage Control Board upheld her findings after a five-hour hearing in Little Rock on June 12.
“Green Springs Medical has repeatedly sold expired products despite sanctions,” Petro ruled. “The public has an interest in quality assurance. This court cannot issue a stay when the appellant continues to willfully sell expired products and the wrong products to the public with total disregard of the regulations.”
