California Cannabis Litigation: Threats of License Loss and Injunctions

An injunction is a request to the court for immediate relief from harm or potential harm. Its purpose is to stop harmful activity, prevent future misconduct or maintain the status quo during the pending litigation. While courts are often hesitant to grant such relief, recent trends suggest a shift in attitude, especially within the cannabis sector.

As any of our litigators will tell you, securing an injunction in California is no easy feat. But California courts may be willing to grant them if cannabis licenses are at stake, in addition to other circumstances such as actual or threatened intellectual property infringement.

What are the legal standards for injunctions?

To receive an injunction, a plaintiff must convince the court, among other things, of the likelihood of success on the merits of its claims and that it will suffer irreparable harm without the relief. As to the first part, the plaintiff must show it will likely succeed on at least one cause of action in its complaint. Marijuana dispensary seeks special permit from Quincy zoning board – The Patriot Ledger

QUINCY − The developers planning a recreational marijuana store on Brook Road will ask the zoning board of appeals for a special permit Tuesday night.

Co-owners Maggie Suprey and Eleanor Winship told The Patriot Ledger they hope to open the women- and LGBTQ-owned Wildflower Cannabis at 159 Brook Road, a small lot in an industrial zone that currently holds construction equipment and vehicles, within a year.

“It’s about providing valuable jobs but also a good community partnership with the city of Quincy,” Winship said.

Suprey said, “We’re feeling really optimistic to get before the board, to present what we’ve worked really hard for a really long time on.”

Two cannabis stores already operate in the city: Quincy Cannabis Co. on Washington Street and the medical dispensary Panacea Wellness on Ricciuti Drive.

Two more recreational stores have come before the board since last summer. In August, a Braintree pharmacist received a special permit to open Pinnacle Cannabis at Water and Liberty streets, less than a quarter-mile from the Wildflower site. In December, the owner of a store in Cohasset got approval to open Chill and Bliss in a former Burger King at 503 Quincy Ave.

The Maryland Cannabis Administration (MCA) has fined Cannabus, LLC for failing to report ownership changes in its annual reports. The company also violated state regulations by transferring a majority ownership interest in its license before it was legally allowed to do so.

According to the Consent Order, Cannabus, LLC received a medical cannabis dispensary license in 2017. In 2020, the company redeemed ownership interests held by three members, effectively giving sole ownership to William Askinazi. However, Cannabus, LLC did not report these transfers to the Maryland Medical Cannabis Commission (MMCC) or the predecessor to the MCA. Furthermore, in its 2021 annual report, the company listed an undisclosed entity called GN Capital 4, LLC (GNC) as a member with 0% equity.

The MCA found that Cannabus, LLC violated state law by transferring ownership interest in its license before it was legally permitted to do so (after three years of operation). The company also violated regulations by failing to submit requests for approval of these transfers before executing them. Additionally, Cannabus, LLC’s inaccurate annual reports violated regulations requiring licensees to accurately report ownership information.

D.C. parents come after new medical licensees 

A few new medical licensees have brought the wrath of D.C.’s elite parents down upon them. Currently, Green Theory, a newly licensed medical dispensary came to a settlement with its ANC, but last week a group of parents raised arms and released a press release claiming “It is unthinkable that D.C. would allow kids as young as 3 years old to be so directly exposed to the sale and consumption of drugs next to the places where they learn and play.” 

However, Green Theory does not have a consumption or summer garden license making it illegal for people to smoke inside or outside the business. Smoking cannabis in public is still illegal in D.C.

 Popville published the press release last week with no attribution and only later added a comment from Green Theory. A T.V. segment also covered the issue but with no comment from the business. 480 people have signed the “1000 feet” petition.
