Texas Activists Sue City That Refuses to Reform Cannabis Laws Despite Ballot Measure Approval

Activists in Texas are suing the city of Harker Heights for failing to reform its cannabis laws after voters approved the changes in 2022, KCEN TV reports. The group, Ground Game Texas, has been behind several successful ballot initiatives in Texas towns and cities that have led to local cannabis law reforms.

In an interview with KCEN, Julie Oliver, executive director for Ground Game Texas said the lawsuit “is about enforcing the will of the voters.”

“Harker Heights officials are undermining local democracy by disregarding the clear language of the city charter. Whatever policy disagreements the city manager or city clerk might have with the voters who approved Proposition A, it’s not the job of city staff to ignore the result of a lawful initiative election. We attempted to negotiate with the city manager and city attorney, but they ignored our attempts. Now we are fighting for the rights of Harker Heights voters in Bell County District Court.”

Harker Heights Assistant City Manager Jerry Bark told KCEN that the city was “not notified of such a lawsuit.”

Dispensary’s suspension to be lifted as early as Thursday – WHO TV 13 Des Moines News & Weather

DES MOINES, Iowa — A popular local shop selling CBD and THC products in Des Moines is finishing up a 30-day suspension this week.

On November 14th, the Department of Health and Human Services sent the owner of Despensary a letter saying that the suspension was issued for selling products that did not comply with state guidelines.

HHS said that Despensary’s hemp-based flower products violated the state’s hemp guidelines.

Ashley Hartman, the Chief Strategy Officer for Central Iowa Vapors, said that there is a general misunderstanding of hemp. She defined hemp as cannabis that contains less than 0.3% of THC by dry weight. This differs from marijuana, which is cannabis that has more than 0.3% THC by dry weight.

Mom’s Meals helps feed Iowans with ‘food as medicine’ approach

Under state guidelines, consumable hemp products manufactured and sold in Iowa must contain less than 0.3% total THC to be legal.

Hartman said, “Iowa allows edibles, tinctures, and topicals. However, they do prohibit the sale of vapables and flower.”

Despensary’s Chief Operating Officer Sabrina Bergloff told Axios last month that the dispensary’s products do not violate Iowa

Seaside Cannabis Company: Cape Cod’s 1st Destination Dispensary “Experience” Opens in Orleans – StreetInsider.com

Locally-owned, centrally located in the commercial hub of the outer-Cape, Seaside offers a unique ‘deli-style’ experience with products thoughtfully curated for all types of consumers.

ORLEANS, Mass., Dec. 13, 2023 /PRNewswire/ — After more than six years of effort, Seaside Cannabis Company is set to open its doors to the public Saturday, December 16th. While the amount of time it took to get here is not unusual for the industry, the way the founders of the business achieved this success was revolutionary.

“Advocacy first” – a public awareness strategy that combines business development with an attention to local community needs and desires – was their preferred approach for Cape Cod. They founded the non-profit organization “Cannabis on Cape Cod” in 2017 with the goal of educating voters and town officials in hopes of quelling fear-based local efforts to ban the industry. The group led many initiatives in Cape towns including Brewster, Barnstable, Sandwich, Mashpee and Orleans, focusing on facts about the cannabis industry that would help overcome unwarranted opposition.

In Orleans, the initial legislation was mixed, allowing for all cannabis business license types except for retail. By 2019 the residents realized the legislation was flawed

Ascend Cannabis has announced plans to leave Montclair only a little over a year after becoming Montclair’s first adult-use recreational dispensary.  Ascend plans to move to Wharton, more than 20 miles away and nearly an hour drive from its current location at 395 Bloomfield Ave.

“We are excited to serve the customers in Wharton in a currently underserved market,” said Rebecca Koar, executive vice president of investor relations and strategy for Ascend Wellness Relations. Koar cited reasons for the move, stating there is “a bit more competition in Montclair” and that parking was a problem. “In Wharton, we will have plenty of parking and the opportunity to serve an underserved community,” she said. The move to Wharton is expected in late summer or early fall of next year.

New York cannabis regulators took their first first step toward opening up new recreational dispensaries on Friday after lawsuits tied up the market since August. Sellers say it’s a step in the right direction but the market still has a long way to go until it’s populated by legal sellers.

The state’s Cannabis Control Board (CCB) greenlit six of the state’s 10 licensed medical marijuana companies to begin adult-use cannabis sales on Dec. 29 — a year after recreational sales first began. The move came at a meeting of the control board in Albany on Dec. 8 — the first since the state settled two lawsuits that have frozen the growth of its marijuana industry since August.
