ST. CHARLES COUNTY, Mo.—Months after voters approved a 3% tax on recreational marijuana in St. Charles County, the county is going to court to defend its right to collect sales tax on the pot products on top of the local tax a municipality may already collect.

The October suit involves a Florissant marijuana dispensary that sued St. Louis County and the state’s revenue director asking for clarity over stacking the taxes
The county says there are 13 marijuana dispensaries in its borders with the potential for generating an estimated $800,000 in tax revenue annually

St. Charles County filed a suit asking to intervene in one filed against St. Louis County in Oct. 2023. It is asserting that counties across Missouri have a legal right to collect sales tax on recreational marijuana sales, even if there is a local sales tax on marijuana.
